Terms and Conditions

1. Eligibility

• Users must be at least 16 years of age.
• Users below 18 years of age must use the Services under the supervision and consent of a parent or legal guardian.
• A valid mobile number and/or email address is required for registration.
• By using the Services, you confirm that you are legally capable of entering into a binding agreement under applicable law.

2. Nature of Platform and Role of Ecstee

Ecstee is a digital facilitation platform that enables users to:

• Discover community hubs, cafes, events, and partner venues ("Partners").
• Make payments through secure third-party payment gateways.
• Earn and use reward/experience points as per applicable program rules.

Ecstee / Ecstee Global LLP does not own, manage, operate, or control any partner hub, cafe, event organizer, or vendor listed on the platform. We are only a digital intermediary between users and Partners.

Partners are solely responsible for:

• Quality, quantity, and specifications of all products and services.
• Pricing, discounts, offers, and availability.
• Hygiene, safety, staff behavior, and overall customer experience.
• Event details, schedule, safety, crowd management, and changes or cancellations.

Ecstee is not responsible for any QA/QC, quality, or quantity related to food, services, events, or products offered by Partners.

3. Account Registration and User Responsibilities

To access most features of the Services, you must create an account. By doing so, you agree to:

• Provide accurate, complete, and up-to-date information.
• Maintain the confidentiality of your login credentials and restrict access to your account.
• Accept responsibility for all activities that occur under your account.
• Use the Services only in compliance with applicable laws and these Terms.

You agree not to:

• Use the Services for any unlawful, fraudulent, abusive, or harmful activity.
• Misuse any reward, referral, or promotion systems, or exploit bugs/loopholes.
• Post or share any defamatory, obscene, hateful, or illegal content.
• Interfere with platform security, attempt hacking, or reverse engineer any part of the Services.

Ecstee reserves the right to suspend or terminate accounts for any violation of these Terms or applicable law.

4. Payments, Platform Fees, Refunds, and Cancellations

• All payments on Ecstee are processed via secure third-party payment gateways (such as Razorpay and similar providers).
• Ecstee / Ecstee Global LLP does not store your full card, bank, or UPI details on its own servers.
• Payment failures, delays, or gateway-level issues are governed by the respective payment gateway's policies.
• Unless explicitly stated otherwise, all sales are final and Ecstee does not provide refunds or cancellations on behalf of Partners.
• Any refund, cancellation, or dispute regarding an order, booking, or event must be taken up directly with the vendor/event organizer/Partner.
• Platform / convenience / processing fees charged by Ecstee are strictly non-refundable under all circumstances, including but not limited to order cancellation, event changes, dissatisfaction, no-show, or disputes with Partners.

5. Experience Points, XT Points, and Rewards

Ecstee may offer experience points, XT Points, InnerPoints, or similar digital rewards (collectively, "Points"). These are designed as a way to build community, reward engagement, and enhance your experience on the platform.

• Points are purely a digital reward and not actual money.
• Points are non-transferable, non-refundable, and cannot be exchanged or redeemed for cash or its equivalent.
• Points may be subject to expiry, change in value, or removal based on Ecstee's policies.
• Ecstee may modify, suspend, or discontinue any reward or points program at any time without prior notice.
• Any fraudulent, abusive, or manipulative use of Points may result in forfeiture of Points and suspension or termination of your account.

Points are not intended for gambling, betting, or any form of financial speculation.

Experience/XT Points are meant as a fun, community-forward way to connect with venues, events, and people—not as an encouragement to overspend or misuse money.

6. Quality, Quantity, and QA/QC Disclaimer

Ecstee is a digital intermediary and does not control or guarantee any aspect of the products, services, or events offered by Partners.

Ecstee is not responsible for:

• Quality, taste, hygiene, or preparation of food, beverages, or any other products.
• Quantity, portion sizes, or any mismatch between expectation and actual service.
• Accuracy of menu, product descriptions, images, or other content provided by Partners.
• Any QA/QC issues, delays, or mistakes in order preparation or fulfillment.

All quality and quantity related issues are strictly between you and the Partner. Ecstee / Ecstee Global LLP is not responsible or liable for such matters.

6A. Events and Event Hosting - Liability Disclaimer

6A.1 Platform Role

Ecstee provides a platform where users can discover and register for events organized by third-party event organizers, hosts, venues, and partners. We are purely a facilitator and technology service provider.

6A.2 Event Organizer Responsibilities

All event organizers, hosts, venues, and partners listed on Ecstee are independent third parties who are solely responsible for:

• Planning, organizing, and executing all aspects of their events
• Obtaining all necessary permits, licenses, approvals, and insurance required by law
• Ensuring compliance with all applicable laws, regulations, safety codes, and health standards
• Providing accurate event information, descriptions, schedules, and terms
• Venue safety, security, accessibility, and suitability
• Crowd management, capacity limits, and emergency procedures
• Quality and safety of food, beverages, equipment, and materials provided
• Conduct and behavior of event staff, performers, vendors, and participants
• Any changes, modifications, postponements, or cancellations to events
• Processing refunds according to their own refund policies

6A.3 Comprehensive Liability Exclusions for Events

ECSTEE / ECSTEE GLOBAL LLP EXPRESSLY DISCLAIMS ALL LIABILITY AND RESPONSIBILITY FOR:

6A.5 Release and Indemnification

By using the Services to discover, register for, or attend events, you hereby:

• RELEASE Ecstee / Ecstee Global LLP and its officers, directors, employees, agents, affiliates, partners, and representatives from any and all claims, demands, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to your participation in any event
• WAIVE any right to sue or bring legal action against Ecstee / Ecstee Global LLP for any event-related matters
• INDEMNIFY and hold harmless Ecstee / Ecstee Global LLP from any claims, lawsuits, or actions brought by third parties arising from your conduct at events or your violation of event terms
• AGREE that this release and waiver applies to all claims, whether known or unknown, foreseen or unforeseen, and whether arising from negligence or otherwise

6A.6 Direct Relationship with Event Organizers

Any tickets, registrations, or bookings made through Ecstee create a direct contractual relationship between you and the event organizer. Ecstee is not a party to that contract. All disputes, issues, or claims must be resolved directly with the event organizer.

Event organizers' terms and conditions, privacy policies, and refund policies govern your participation in their events, not Ecstee's policies.

6A.7 No Endorsement or Verification

The inclusion of any event, organizer, or venue on Ecstee does not constitute an endorsement, recommendation, verification, or guarantee of quality, safety, or legitimacy by Ecstee / Ecstee Global LLP.

We do not conduct background checks on event organizers, verify event information, inspect venues, or guarantee the accuracy of any event-related content. Users are solely responsible for conducting their own due diligence before attending events.

7. Limitation of Liability and Assumption of Risk

By using the Services, you acknowledge and agree that you participate in events, visit venues, and engage with Partners at your own risk.

Ecstee / Ecstee Global LLP is not liable for:

• Vendor or Partner service failures, cancellations, changes, or dissatisfaction
• Event disruptions, crowd-related issues, stampedes, or safety incidents at any venue or event
• Loss, theft, or damage to personal belongings, vehicles, or valuables at any Partner location or event venue
• Personal injury, illness, accident, disability, death, or other harm occurring at or related to Partner spaces or events
• Food poisoning, allergic reactions, contamination, or health hazards from food/beverages
• Inadequate venue facilities, accessibility issues, or unsafe conditions
• Conduct, behavior, or criminal actions of event organizers, participants, or third parties
• Accuracy, completeness, or reliability of event information, Partner details, or user-generated content
• Weather disruptions, natural disasters, or force majeure events affecting events
• Transportation issues, parking problems, or difficulties reaching venues
• Network errors, bugs, downtime, technical glitches, platform maintenance, or service interruptions
• Unauthorized access, data loss, security breaches, or misuse of information beyond our reasonable control and security measures
• Third-party payment gateway failures, transaction errors, or payment processing issues
• Loss of Points, rewards, or benefits due to account suspension, technical issues, or policy changes
• Any consequential, indirect, incidental, special, punitive, or exemplary damages, including lost profits, lost data, or business interruption

7.1 Maximum Liability Cap

To the maximum extent permitted by applicable law, Ecstee / Ecstee Global LLP's total aggregate liability for any and all claims arising out of or related to these Terms or your use of the Services shall be limited to the amount of platform/convenience fees paid by you to Ecstee for the specific transaction in question during the twelve (12) months preceding the claim, excluding any amounts paid to Partners, event organizers, or third-party payment gateways.

7.2 No Liability for Events

IN NO EVENT SHALL ECSTEE / ECSTEE GLOBAL LLP BE LIABLE FOR ANY DAMAGES, INJURIES, LOSSES, OR CLAIMS ARISING FROM OR RELATED TO YOUR PARTICIPATION IN, ATTENDANCE AT, OR REGISTRATION FOR ANY EVENT LISTED ON THE PLATFORM, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.

7.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law. However, the limitations in Section 6A (Event Hosting) shall apply regardless of jurisdiction to the fullest extent legally permissible.

8. User Conduct

In addition to other clauses, you agree not to:

• Impersonate any person or entity.
• Use bots, scripts, or unauthorized tools to interact with the platform.
• Interfere with or disrupt the integrity or performance of the Services.
• Engage in any conduct that harms the community, Partners, or the reputation of Ecstee.

9. Content and Intellectual Property

All trademarks, logos, branding, designs, UI/UX elements, text, graphics, images, and software related to Ecstee are the intellectual property of Ecstee Global LLP or its licensors.

You may not copy, reproduce, distribute, modify, create derivative works of, or otherwise use any part of Ecstee's content or branding without prior written permission.

10. Account Suspension and Termination

Ecstee may, at its sole discretion, suspend, restrict, or permanently terminate your access to the Services if:

• You violate these Terms or any applicable law.
• You are involved in fraud, abuse, manipulation of rewards, or suspicious activity.
• Your behavior harms other users, Partners, or the platform.

You may request closure of your account at any time by contacting our support team. Some information may be retained as required by law or for legitimate business purposes.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India.

You agree that all disputes, claims, or controversies arising out of or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana, India.

12. Changes to These Terms

Ecstee may update, modify, or revise these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page.

Your continued use of the Services after any such changes will be deemed as acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Services.
